UPDATE January 4, 2021: Bill died in committee
Senate Bill 109 was introduced on January 24, 2019 and subsequently referred to the Transportation Committee. On March 27, the bill was set for first consideration.
SB 109 would amend Section 3744 of Title 75 of the Pennsylvania Consolidated Statutes. That section outlines the duty of the driver involved in an accident to provide information and render aid if possible. Paragraph (c) allows for passengers to assume that duty if the driver of the vehicle is disabled. The SB 109 amendment would also obligate passengers to assume that duty if the driver refuses or neglects, in their opinion, to provide information or assist. The driver has rights that this piece of legislation would take away if enacted.
