UPDATE 6/30/22: Bill died in committee

House Bill 85 would provide for a 2022 fall election ballot initiative related to the use of speed cameras. Specifically, the initiative would ask voters to approve an amendment to the state constitution banning the use of speed cameras throughout the entire state. If passed, the amendment would become effective January 1, 2023. It is before the House Municipal Committee.

The NMA is opposed to automated traffic enforcement, including speed cameras, for a number of reasons including:

  • Photo radar can generate false readings
  • This type of automated enforcement emphasizes ticket volume
  • There is no certifiable witness to the alleged violation
  • The driver of the vehicle is not positively identified by the camera which means, by default, the owner of the vehicle receives the ticket whether or not he/she was the driver at the time of the alleged violation
  • Speed cameras have not been shown to improve traffic safety

For these reasons, the NMA supports this initiative as a way to harness public opinion against speed cameras and deliver a decisive blow to the automated traffic enforcement industry.
